These Terms of Service ("Terms") govern your use of Starky Translate, a translation application operated by Sala Software d.o.o., a company registered in Slovenia ("we," "us," or "our").

By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use our Service.

1. Acceptance of Terms

By creating an account, downloading, installing, or using Starky Translate, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms constitute a legally binding agreement between you and Sala Software d.o.o.

2. Description of Service

Starky Translate is an artificial intelligence-powered web translation application that provides:

  • Text translation between multiple languages
  • Speech-to-text and text-to-speech functionality
  • Image and camera-based text translation
  • Proofreading and language assistance features

Important Notice: Our Service is a web-based application that requires an internet connection to function. Our Service uses artificial intelligence technology to provide translations. While we strive for accuracy, AI-generated translations may contain errors, inaccuracies, or cultural misinterpretations.

3. User Accounts and Registration

3.1 Account Creation

  • You must provide accurate and complete information when creating an account
  • You are responsible for maintaining the confidentiality of your account credentials
  • You must be at least 13 years old to create an account
  • One person may not maintain multiple accounts

3.2 Account Responsibility

  • You are solely responsible for all activities that occur under your account
  • You should notify us if you become aware of any unauthorized use of your account
  • We reserve the right to suspend or terminate accounts that violate these Terms

Our Service currently offers free usage tiers with built-in limits:

6.4 No Liability for Translation Errors

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL LIABILITY FOR:

  • Inaccurate, incomplete, or misleading translations
  • Damages resulting from reliance on AI-generated translations
  • Business losses, missed opportunities, or financial damages caused by translation errors
  • Miscommunication or misunderstanding resulting from translation inaccuracies
  • Any direct, indirect, incidental, consequential, or special damages arising from translation use

7. Intellectual Property Rights

7.1 Our Rights

  • Starky Translate and all related intellectual property remain our exclusive property
  • Our trademarks, logos, and branding materials are protected by applicable laws
  • The underlying AI models and translation technology are licensed to us by third parties

7.2 Your Content

  • You retain ownership of content you submit for translation
  • By using our Service, you grant us a limited license to process your content for translation purposes only
  • We do not store or retain your translation content as described in our Privacy Policy
  • You represent that you have the right to submit any content for translation
  • You are solely responsible for ensuring your content complies with applicable laws and does not infringe third-party rights
  • We are not responsible for the nature, legality, or ownership of content you submit

7.3 Translation Outputs

  • Translation outputs are provided "as is" without any warranty of accuracy
  • You may use translation outputs for your personal or business purposes
  • We claim no ownership over translation results
  • You are responsible for any use of translation outputs

8. Service Availability and Modifications

8.1 Service Availability

  • We strive to maintain Service availability but do not guarantee uninterrupted access
  • We may perform maintenance, updates, or improvements that temporarily affect availability
  • We are not liable for service interruptions or downtime

8.2 Service Modifications

  • We reserve the right to modify, update, or discontinue features at any time
  • We may change pricing, usage limits, or service terms with reasonable notice
  • Continued use after changes constitutes acceptance of modified terms

8.3 Payment and Refunds

  • Character packages are one-time purchases. We do not offer recurring subscriptions for credits at this time.
  • Purchased credits are available for use for up to one year from the purchase date, unless otherwise stated at checkout.
  • You can request a refund within 30 days of purchase for unused paid credits.
  • If credits from that purchase were used, we refund only the unused paid portion.
  • To request a refund, email contact@sala.si from your account email and include your order ID.
  • We review refund requests within 5 business days.
  • Approved refunds are sent to the original payment method. Banks and payment providers may take additional time to post the refund.
  • Free, bonus, or promotional credits are not refundable.
  • This refund policy does not limit any rights you have under applicable consumer law.
  • Invoices for companies are supported during checkout when billing details are provided.

9. Limitation of Liability and Warranties

9.1 "AS IS" Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability, fitness for a particular purpose, or non-infringement
  • Warranties regarding accuracy, reliability, or quality of translations
  • Warranties that the Service will meet your specific requirements
  • Warranties that the Service will be error-free or uninterrupted

9.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

  • Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim
  • We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
  • This limitation applies regardless of the theory of liability (contract, tort, negligence, etc.)
  • This limitation applies even if we have been advised of the possibility of such damages

9.3 Essential Purpose

You acknowledge that these limitations are essential elements of our agreement and that we would not provide the Service without them.

10. Indemnification

You agree to indemnify, defend, and hold harmless Sala Software d.o.o., its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any applicable laws or third-party rights
  • Any content you submit for translation
  • Any reliance on translation outputs for critical decisions

11. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and protect your information. By using our Service, you consent to our privacy practices as described in our Privacy Policy.

12. Termination

12.1 Termination by You

You may terminate your account at any time by contacting us or using account deletion features in the application.

12.2 Termination by Us

We may suspend or terminate your account if you:

  • Violate these Terms or our policies
  • Engage in fraudulent or illegal activities
  • Cause harm to our Service or other users
  • Fail to pay applicable fees (if any)

12.3 Effect of Termination

Upon termination:

  • Your right to use the Service immediately ceases
  • We may delete your account data in accordance with our Privacy Policy
  • Sections of these Terms that should survive termination will remain in effect

13. Dispute Resolution

13.1 Governing Law

These Terms are governed by the laws of Slovenia, without regard to conflict of law principles.

13.2 Jurisdiction

Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Ljubljana, Slovenia.

14. Miscellaneous

14.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service.

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

14.3 No Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.

14.4 Assignment and Business Transfers

We may assign these Terms in connection with a merger, acquisition, or sale of all or substantially all of our assets. In such cases:

  • All users will be notified at least 30 days before any business transfer involving personal data
  • The acquiring entity must provide equivalent data protection guarantees
  • Users may exercise their rights to data portability, erasure, or withdrawal before the transfer
  • If the transfer would involve processing for purposes incompatible with the original purposes, we will obtain user consent

14.5 Updates to Terms

We may update these Terms periodically. We will notify you of material changes via email or application notification. Continued use after changes constitutes acceptance of modified Terms.

15. Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, strikes, government actions, or technical failures of third-party services.
